Garland: Questioning the Integrity of the Justice Dept. is an Attack on — You Guessed It

What the Left really means by "democracy."

With the sweetheart deal that Hunter Biden just got from federal prosecutors, Attorney General Merrick Garland has once again confirmed that he has taken the Justice Department, which was once the envy of the world for its indefatigable commitment to equal justice for all, and turned it into a squad of legal hit men for foes of the Biden regime and a legal laundromat for the regime’s members and cronies, most notably for the alleged president’s crackhead influence-peddling son. Garland himself, however, bristles if you believe your lying eyes on this matter. On Friday he complained that charges that his Justice Department was doling out frame jobs for dissidents and skates for friends of the regime was a threat to — that’s right! — our “democracy.”

As has been pointed out many times, when Leftists profess to be worried about the health of “our democracy” (I know, I know, it’s a republic), they’re really referring to threats to their own hegemony over the nation’s political and cultural spheres. Garland confirmed this Friday when a reporter noted that some Republicans are talking about the corruption of the Justice Department, and asked him: “Do the American people have cause to be concerned about the integrity of the components of this Justice Department, and what do you have to say about how they’re reacting?”

In his answer, Garland went as heavy on the self-righteous unctuousness as a kid drenching his fries in ketchup: “I certainly understand,” he huffed, “that some have chosen to attack the integrity of the Justice Department as components and its employees by claiming that we do not treat like cases alike. Uh, this constitutes an attack on an institution that is essential to American democracy and essential to the safety of the American people. Nothing could be further from the truth.” There it is: attack Merrick Garland and his revoltingly corrupt henchmen, and deplore the dumpster fire they have made out of a department that is supposed to administer impartial justice, and you’re attacking “American democracy.”

Note Garland’s appalling sleight of hand: he equates an attack on his Justice Department, which is a gang of Leftist liars who tried to frame an elected president of the United States for crimes he didn’t commit and classified angry parent at school board meetings as terrorists, with an attack on the very idea of a Justice Department. For he is of course right, as far as it goes: the Justice Department is indeed essential to American democracy, or rather, to the American republic. That’s why we’re in the fix we’re in: because the Justice Department is now a public relations office for those whom the regime favors and a no-holds-barred instrument of vengeance against those whom the regime hates. Those who are attacking it are not against the institution at all but against the mess that Garland has made of it.

Garland, however, insists that he and his far-Left minions have behaved with perfect probity. He added: “You’ve all heard me say many times that we make our cases based on the facts and the law. These are not just words. These are what we live by. They’re the foundation of the way we make these decisions.” Gee, that’s reassuring, but here’s a shocker: Garland was not exactly being honest.

Just the News reported Thursday that “Internal Revenue Service whistleblowers are directly challenging Attorney General Merrick Garland’s claim that David Weiss, the U.S. attorney in Delaware, was allowed to run his Hunter Biden tax probe free of political interference.” Sen. Chuck Grassley (R-Iowa) recently asked Garland “to describe what would happen if Weiss wanted to pursue charges against President Biden’s son outside of his Delaware jurisdiction, considering Garland hadn’t made him a Justice Department special counsel.”

Garland responded, “I promise to ensure that he’s able to carry out his investigation and that he’d be able to run it. And if he needs to bring it in another jurisdiction, he will have full authority to do that.” However, an IRS said that at an Oct. 2022 meeting between Weiss, IRS investigators, and FBI agents, Weiss was told he could not bring his case against Hunter Biden to Washington. “And then he went back and asked for special counsel authority, and they told him no.” Impartial justice!

House Republicans could do a great deal to expose and end the Justice Department’s deep corruption if they impeached Merrick Garland. Aside from Old Joe himself, no Biden regime official would be more deserving.

Exclusive: Support Mounts Among House Judiciary Republicans for Merrick Garland’s Impeachment

WASHINGTON, DC - AUGUST 11: U.S. Attorney General Merrick Garland delivers a statement at the U.S. Department of Justice August 11, 2022 in Washington, DC. Support among House Judiciary Committee Republicans for an impeachment inquiry into Attorney General Merrick Garland grew stronger after House Speaker Kevin McCarthy threatened impeachment proceedings if IRS whistleblower allegations turn out to be true regarding the politicization of the Justice Department’s Hunter Biden tax probe.

IRS whistleblowers told Congress last week the DOJ twice prevented United States Attorney David Weiss from bringing stronger charges in two separate locations against Hunter Biden. In addition, the whistleblowers alleged Garland rejected a request to appoint a special counsel in the probe to place a degree of separation between the DOJ and President Joe Biden.

IRS whistleblower Gary Shapley claims his allegations can be corroborated by several individuals with firsthand knowledge of Shapley’s account of his communication with Weiss. “It’s up to him and the Justice Department to reconcile the evidence,” Shapley said through his attorney.

Garland denies the DOJ politically interfered in the investigation of the president’s son. Garland says Weiss had full authority to charge Hunter Biden, even though Garland admitted to Congress in March he was the authority to authorize any potential charges against Hunter Biden — including in a separate “jurisdiction.”

The conflicting stories caused McCarthy on Sunday to threaten impeachment proceedings against Garland if the whistleblower allegations are found to be true.

Several Republican House Judiciary Committee members told Breitbart News that they support McCarthy considering an impeachment inquiry. Impeachment proceedings must originate from the House Judiciary Committee before reaching a full House vote.

“It’s not an empty threat,” senior committee member Rep. Darrell Issa (R-CA) exclusively told Breitbart News. “Congress can’t just look away from the culture of corruption that’s there for all to see, and the possibility of impeachment has to be on the table.”

“From the start, AG Garland has allowed partisan politics to hold sway in the Justice Department — including the unprecedented targeting of parents,” he added.

“Whistleblower allegations related to the Hunter and Joe Biden investigation make it abundantly clear a two-tiered system of justice exists today,” Rep. Harriet Hageman (R-WY) told Breitbart News. “I fully support Speaker McCarthy on this issue and welcome the opportunity to question Mr. Garland in Judiciary Committee hearings.”

“The Department of Justice, and the entirety of the federal government, must be a fair and impartial agency that enforces federal law, but under current leadership, it is a political weapon used to punish opponents of the president,” she said.

Rep. Andy Biggs’ (R-AZ) and Rep. Troy Nehls’ (R-TX) senior staff also issued statements in support of impeachment proceedings to Breitbart News.

“Congressman Nehls absolutely supports McCarthy’s position that Garland should be impeached,” said Nehls’ Communications Director Taylor Hulsey.

“Congressman Biggs is on board,” Communications Director Matthew Tragesser told Breitbart News.

In a clip shared with Breitbart News from Rep. Chip Roy’s (R-TX) Communications Director Nate Madden, the Texas congressman also supported the potential impeachment proceeding if the allegations prove true.

Scott Perry (R-PA) speaks during a news conference on the debt limit negotiations at the U.S. Capitol Building on March 10, 2023 in Washington, DC. “That certainly raises questions of impeachability. There is no question about that,” Roy told WMAL. “That’s what inquiries are for … We’ve got an obligation on the Judiciary Committee to pursue it wherever it goes.”

McCarthy appeared Monday on Fox and Friends and doubled down on his vow of imminent impeachment proceedings against Garland if the whistleblower allegations are true.

“Yesterday, I laid out very clearly by July 6, because of the allegations of the IRS, because of the whistleblowers and Garland — what he is saying and what Weiss is saying are two different things,” McCarthy said. “And if it is true what the IRS whistleblowers are saying, we will start impeachment inquiries on the attorney general.”

Whistleblower No. 2: Hunter Biden Willfully Evaded Millions in Taxes Through Elaborate Tax Scheme

Family members gather for a road naming ceremony with U.S. Vice President Joe Biden, centre, his son Hunter Biden, left, and his sister Valerie Biden Owens, right, joined by other family members during a ceremony to name a national road after his late son Joseph R. "Beau" Biden III, in …

Hunter Biden agreed to plead guilty last week to two misdemeanor counts of failing to pay taxes on time, but according to the second whistleblower whose testimony was also released last week by the House Ways and Means Committee, he also willfully evaded paying millions in taxes in an elaborate tax scheme.

According to the second whistleblower — the lead IRS case agent for the Hunter Biden investigation whose name is redacted — Hunter Biden set up a scheme involving a Ukrainian natural gas company he sat on the board of and a Chinese business associate to willfully evade paying taxes.

The whistleblower said Hunter Biden had already owed hundreds of thousands of dollars in taxes long before his father became vice president. In 2014, when the Joe Biden was in his second term as vice president in charge of Ukraine policy and when Ukrainian natural gas company, Burisma, put Hunter on its board of directors, Burisma paid Biden $666,667 to do little or no work.

According to the whistleblower, Hunter Biden received the money from Burisma, and instead of reporting it as income and paying taxes on it, he put that money into a Chinese firm run by one of Hunter Biden’s associates, who then “loaned” the money to Hunter Biden.

The whistleblower testified:

So [Hunter Biden] sets this out in this email and what ends up happening is — so imagine this. If you are an owner of a company and your friend tells you that, I want to pay my wages to your company and you’re going to loan the money back to me, that’s essentially what happened here. He took loans from that corporation — which were distributions. And he didn’t pay taxes on those loans.

So essentially for 2014, we had found that Hunter didn’t report any of the money he earned from Burisma. So the reason why this is important is because Hunter set it up this way, to not — to essentially earn the money through his friend’s corporation and then have his friend pay him back half of the money as loans, quote, unquote, loans. …

The whistleblower continued, “None of it was taxed. … So none of this has been paid or prosecuted. And I would also like to note that the statute has run out on these tax years or on the 2014 tax year.”

The whistleblower said the Justice Department believed Biden’s defense that the money was a loan.

“You can’t loan yourself your own money. It just doesn’t make any sense,” the whistleblower said.

When asked if the transactions seemed to be a “sham,” the whistleblower answered, “So, yes, I would agree that the transactions would — you would want to sham the transactions, yes.”

As the Washington Examiner’s Byron York noted, Biden’s income in 2014 was not part of the misdemeanor charges against him, and the statute of limitations was allowed to expire.

The whistleblower also noted that Hunter Biden’s friend, a wealthy Hollywood celebrity lawyer named Kevin Morris, had paid off the $2.2 million that Hunter Biden owed the IRS for years 2014 through 2019.

The whistleblower said on Hunter Biden’s 2020 tax returns he included a note that he had received financial support from Morris of $1.4 million, which both agreed to treat as a loan with 5% interest to be paid between 2025 and 2027.

“The taxpayer is treating this amount as a loan for tax purposes. The balance of the financial support is treated as a gift. No amount of the support is treated as a reported taxable event on this return,” the note said.

Morris would give Hunter Biden approximately $800,000 more, totaling $2.2 million to pay off the taxes he owed.

When asked if that transaction had been investigated, the whistleblower said he did not know since he and the other whistleblower, Gary Shapely, were removed from the investigation by then.

York wrote:

And now the matter has been resolved with two misdemeanor charges. The conclusion is deeply frustrating to IRS agents like [whistleblower #2]. Hunter Biden failed to file returns, failed to pay his taxes for several years, and falsely claimed deductions. … The agents’ conclusion is that just because Hunter Biden’s new friend bailed him out — no repayments required until 2025 — does not mean Hunter Biden did not violate the tax laws repeatedly in the 2010s.

“At the end of WB2’s deposition, a Republican lawyer asked this question: ‘If someone meets all the elements for a crime of willful evasion and are found to, in conjunction with that, owe a liability, and they pay off that liability years later when they’ve been caught, has a crime been committed?’ WB2 answered simply: ‘Yes.'” York concluded.
